'Spider-Man' Stuntman, Citing Injuries, Starts Legal Action ...

A sixth performer from the Broadway musical ?Spider-Man: Turn Off the Dark? is said to have been injured during the show?s run last winter ? and he has become the first to take legal action against the ?Spider-Man? producers. The stuntman, Richard Kobak, who played Spider-Man in some of the musical?s flying sequences, says that he sustained two herniated discs, a concussion, whiplash and holes in both knees as a result of errors by crew members in charge of programming the aerial rigging computer.

In legal papers filed in State Supreme Court in New York on Tuesday, a lawyer for Mr. Kobak asked the ?Spider-Man? producers for documents, e-mail and other material dealing with the computer system and the concerns of Mr. Kobak, who said in an affidavit that he had warned the show?s aerial designer, Scott Rogers, at that time that the stunts weren?t working properly.

According to the legal papers, Mr. Kobak had replaced another stuntman, Christopher Tierney, who was injured after a 30-foot fall from a platform at the Dec. 20, 2010, performance. (Mr. Tierney?s injury was caused by human error; he recovered and rejoined the show.) Mr. Kobak asserts that because of the weight difference between himself and Mr. Tierney the computer system needed to be recalibrated to slow down and soften Mr. Kobak?s landings on stage after flight sequences. He asked Mr. Rogers about this, according to the court papers, and was told that the computer was being reprogrammed.

Mr. Kobak asserts that the computer correction was not made until he had completed 16 performances of ?Spider-Man,? during which he landed ?very hard on stage.? (He also said he had sustained dozens of hard landings during rehearsals.) He said in his affidavit that his right knee has a hole of .14 cm and his left knee has a hole of .9 cm. He also said he sustained another flying-related injury last April when, he said, at the behest of Mr. Rogers he changed his timing and body positioning during a stunt to align with the computerized rigging. As a result, he said in the affidavit, ?I was pulled straight into the wall striking my head and face into the wall,? from which he had the concussions, herniated discs and other injuries.

Rick Miramontez, a spokesman for the ?Spider-Man? producers, said in an e-mail statement, ?The producers have no comment on the matter except to wish Mr. Kobak, who is currently in the ?American Idiot? tour, well.?

Five other ?Spider-Man? performers, including Mr. Tierney, were injured during rehearsals in the fall of 2010 and after performances began that November; among them were two lead actresses at the time, Natalie Mendoza (who ultimately left the show) and T. V. Carpio, who both sustained head injuries while playing the spider-woman Arachne. None of those five is known to have sued, though Ms. Mendoza received a confidential financial settlement on the condition that she leave the show without criticizing it.

Mr. Kobak is the latest legal thorn in the side of the producers, who are already contending with a lawsuit from the show?s former director, Julie Taymor; they have countersued her.

?Spider-Man? is the most expensive musical in Broadway history, at a cost of $75 million, and is also the New York theatrical debut of its famous composers, Bono and the Edge of U2. The show opened last June to mostly negative reviews after a long, troubled period of preview performances when the various injuries occurred. The show never had an out-of-town tryout production, which is when most musicals work out their technical difficulties.

?Spider-Man? is regularly among the top-selling shows on Broadway, grossing roughly $1.5 million a week, But because the musical?s weekly running costs exceed $1 million, ?Spider-Man? has been making only a modest profit most weeks. The producers have recently begun exploring options for going overseas with ?Spider-Man? productions and arena concerts spun off from the show to help earn back the $75 million capitalization.

Crisis looms for US science, physicists warn

The United States is at risk of ceding its leadership in science, a number of physicists agreed this week, though there was less of a consensus on a clear solution to the problem.

Five physicists shared their worries about America's scientific future during a panel discussion here on Monday at the April 2012 meeting of the American Physics Society, saying that governmental funding for science research is in crisis, and not enough U.S. students graduate with degrees in science, technology, engineering and math.

"There are some facts and figures that are very disturbing, which show the United States might be losing ground in science and discovery, whereas other countries are gaining," Pushpa Bhat, a physicist at Illinois' Fermi Accelerator National Laboratory (Fermilab), said at a news conference preceding the panel. "We can't sit back and watch."

Bhat lamented the lack of cutting-edge physics facilities in this country. While many of the world's best instruments and experiments, such as Fermilab's Tevatron particle accelerator, used to be housed here, that frontier has moved elsewhere. For example, the world's largest atom smasher, the Large Hadron Collider, is located at the CERN lab in Switzerland, while Illinois' Tevatron has shut down.

"There are things that the country will miss out on if we don?t have such facilities here," Bhat said.

However, she and other physicists also said that now is a time for greater international collaboration between scientists, and that other countries' gains are not necessarily our losses.

"I think science is largely impervious to national boundaries," said Nobel Prize winner Frank Wilczek of MIT. "The U.S. still has leading efforts in most areas of science, and attracts students from all over the world. But I don't think we take advantage of that resource, because we make it difficult for them to stay. I think for science, it's a tragedy."

Wilczek said that both America's immigration laws and its cultural attitudes toward foreigners could be more welcoming.

And the physicists acknowledged that scientists will have to confront a hard reality: There is simply less money for research in the current economy. [Graphic: Science Funding in the Federal Budget]

"We need to redouble our efforts to make sure the projects we select are of the highest importance and impact, and be on the lookout for new technologies and innovations that would allow us to do more of our science goals with more modest resources," said Timothy Hallman, associate director of science for nuclear physics at the U.S. Department of Energy (DOE).

Jim Siegrist, director of the Office of High Energy Physics in DOE's Office of Science, agreed.

"We need to find a way to do more science with a fixed amount of money," Siegrist said.

"I think it'd be easier just to have more money," Wilczek replied.

He argued that society doesn't adequately value and recognize the economic benefits of basic science.

"Think about how much the invention of the transistor is worth," Wilczek said. "The fundamental science that went into that was understanding quantum mechanics, understanding the micro world. Bohr didn't get rich from it, Heisenberg didn't get rich from it. But society got rich from it." (Niels Bohr and Werner Heisenberg were two of the pioneers of quantum mechanics.)

A number of the scientists stressed the importance of communicating the value of science to the public.

"The science community can do so much more to engage on the policy side," said Neal Lane, a physicist at Rice University and a senior fellow in science and technology policy at the university's Baker Institute for Public Policy. "We are not connecting as well as we should."

"It looks like we are doing a lot of outreach, but it has not been effective," Bhat said. "Maybe we are always preaching to the choir. Maybe we should have scientists talk to Jay Leno." [8 Celebs Who Promote Science]

Ultimately, most of the physicists expressed some optimism about the future, particularly given the major advances being made in understanding the universe and its tiny components, from dark matter and dark energy to exotic particles such as the Higgs boson.

"It's really an exciting time for science, and I think that ultimately we'll win if we could just communicate that in a clear way," Siegrist said. "I think we can resonate with the decision-makers inside the Beltway. There's plenty of science to do for the whole planet. We don't actually need to colonize the moon to have enough science to do."

Verdict: An eye-opening account of the supposedly All American store and makes for a thought-provoking read that may have you frowning at the Smiley Face.

Wal-Mart?s Egonomics Always is the tale of how ADDvantage Media Group, Inc, (AMG) a vendor of shopping cart calculators, partnered with Wal-Mart and were systematically destroyed by the corporate mega-store through continual mishandlings, turnovers in high level associates who were working on the accounts and an overall attitude of greed and deception.

Author Charles H. Hood recounts his approximately seven-year predicament with Wal-Mart.? He was the product salesman for AMG and approached them with the shopping cart calculator. This product was designed to increase sales by the consumer by allowing them to calculate their expenditure to the penny, rather than rounding up to the nearest dollar.? According to Hood, though Wal-Mart allowed the installation of the calculators on their shopping carts and profited from their use, Wal-Mart, managed to skip paying for them and never fulfilled their end of the deal, which was to help promote AMG for this product. In the meantime, AMG was left to pay the monies required for the manufacturing of the product. Despite persistent follow up, Wal-Mart managed to continue avoid payment due to employee rehires of key associates involved in the partnership between AMG and Wal-Mart, and the supposed lack of knowledge between the departments. Hood eventually came to believe it was Wal-Mart?s ruthless philosophy of squashing all competition that led to the bad business deal.

Hood makes a strong case against Wal-Mart?s treatment of its vendors and competition, citing pages and pages of correspondence and court documents, including criticisms of Wal-Mart by sources such as ABC News and Business Week. Hood?s sentiments about his experience with Wal-Mart are passionate and persuasive.

Hood?s writing is clear and to the point, however throughout the book he relies heavily on exclamation points in chapter headings and many sentences and paragraphs appear in bold for emphasis rather than trusting the reader to see the significance of his words. Though intriguing, some of the court documents are in very small print, which breaks up the flow of the read. Despite these stylistic points, Walmart Egonomics Always, is an eye-opening account of the supposedly All American store and makes for a thought-provoking read that may have you frowning at the Smiley Face.

As the deadline passed midnight Sunday for payment of a new government fee, only?49 percent of households had signed up to pay amid frustration with the government's austerity agenda.?

A majority of Irish households have refused to pay a new government fee in a tax revolt led, unusually, by socialists.?

The Irish government levied the new tax in an attempt to shore up the country's finances that were devastated by economic collapse and a series of bank bailouts. But as the deadline passed midnight Sunday, only?49 percent of households had signed up to pay.

With no rioting and few protests, Ireland had been until now the quietest of the ravaged economies on the fringes of the European Union. However, the tax revolt reveals significant frustration here to budgetary reforms and foreshadows trouble ahead for the government's efforts to meet EU bailout demands.

Ruth Coppinger, spokesperson for the Campaign Against Household and Water Taxes and Socialist Party councilwoman for Dublin, says the refusal to pay the property tax ??and forthcoming water metering ? is a rejection of austerity policies ushered in by the government at the behest of the EU, European Central Bank, and International Monetary Fund.

"The mood in society has changed. The general feeling is that we didn't create this mess and we're being asked to pay for it," she says.

Flat fee first, then property tax

All Irish households are being charged a flat fee of ?100 ($133) with the promise that the "household charge" will be replaced by a tax based on property value in 2013.

Minister for the environment Phil Hogan thanked those who had registered to pay the tax, saying: ?I know that Irish people have had a difficult time time of it over the last few years and, in spite of that 800,000 have registered and paid the charge. They understand the need to pay for local services and, by paying the household charge, they have made their valuable contribution to the continuation of essential services at the local level."

Estimates on how many dwellings are liable to pay vary, with the government saying 1.6 million and opponents of the levy saying the census reveals 1.8 million. But with at least half of the households in the country refusing to pay the government is coming under intense pressure.

The opposition is being led by left-wing parties in parliament, including the Socialist Party, the People Before Profit Alliance, and Sinn F?in.

Ireland has no ongoing property tax

Unlike other European countries, Ireland has had no ongoing property tax since "residential rates" were abolished in 1977. A stamp duty tax is paid on buying a property, while a flat annual charge of ?200 ($266) is levied on second homes.
